Criminal Defense Attorney Yale Galanter Weighs in on John Goodman DUI Manslaughter Verdict

As a Miami criminal defense attorney who has practiced for over 30 years in the south Florida area, I have seen many tragic cases. The Goodman case inPalm Beachis one such case. Wealthy businessman who is a charitable member of the community has too much to drink one night and an innocent person ends up dead.

Goodman was convicted of DUI manslaughter and sentenced to 16 years in prison. The victim’s family got a 40 million dollar wrongful death settlement. I am sure that if Goodman and the victim’s family could turn back the clock they would.

Goodman was granted a 7 million dollar appellate bond yesterday in aPalm Beachcourt. By stipulation of the prosecutor and defense, Goodman will be allowed to remain out on bond while the case is on appeal. This occurred because underFloridalaw if you are convicted of a crime you have a right to appeal. If there are valid grounds for the appeal, no matter how tenuous they may be, a post conviction bond is appropriate. The prosecution knew that the judge would most likely grant a bond and wanted to ensure the terms and conditions were satisfactory to them. The defense took a sure thing also so their client would remain free during the long appellate process. Smart move on both sides.

The amount of bond is warranted given the sentence imposed and the defendant’s wealth. Bond is intended to assure ones appearance at all future court proceedings. These creative bond conditions call for police officers to watch Goodman sleep. He is also confined to his community. His risk of flight is diminished greatly. We’ll see what happens with his appeal.
