Miami Criminal Defense Attorney Yale Galanter Discusses the Etan Patz Murder Confession

There is no statute of limitations for a murder charge.  After 33 years the New York Police Department have finally made an arrest in the Etan Patz case.  To the credit of the New York Police Department, they did not let this case go cold and kept the investigation open continuing to talk to witnesses and investigate the case.  While the suspect arrested is presumed innocent, local reports are that he has now confessed to the police twice and gave a three and a half-hour confession. Whether the defendant will eventually plead guilty and be sentenced for this crime 33 years later is an open question. As is whether Etan’s parents will finally have some closure.

Presently the defendant is at Belleview Mental Hospital undergoing evaluation for known mental disorders. The only evidence against the accused is his own confession. There is no evidence to corroborate that confession. People confess to crimes they didn’t commit all the time. They either have mental delusions which may be the case here, or they are seeking media attention. There have also been reports that the police spoke to the defendant many years ago where he confessed and the police did not believe him at that time.

Without some corroboration the confession will always be in doubt. Hopefully the police will continue to bolster their case so that Etan’s parents may finally have closure and peace.
